تأجيل النظر في قضية ‘حمزة مون بيبي’

قررت محكمة الاستئناف بمراكش، امس الأربعاء، تأجيل النظر في قضية "حمزة مون بيبي"، الذي عرف بالتشهير بالفنانين والمشاهير وابتزازهم، وذلك إلى غاية 21 أكتوبر الجاري.
وعلم لدى مصدر قضائي أن "قاضي غرفة الجنايات بمحكمة الاستئناف قرر إرجاء النظر في هذا الملف، الذي تتابع فيه كل من (د.ب) في حالة سراح و(ا.ب) و(ع.ع) و(ص.ش) في حالة اعتقال، بناء على طلب دفاع المطالبين بالحق المدني الذي التمس إعداد مرافعة الدفاع والإطلاع على حيثيات الملف في كل جوانبه".
وأضاف المصدر ذاته أن "ثاني الجلسات الاستئنافية في القضية تميزت بحضور المتهمة (د.ب) والمشتكين، فيما غابت باقي المتهمات الثلاث اللواتي تعذر إحضارهن نتيجة للتدابير الصحية المعمول بها للوقاية من فيروس كورونا المستجد (كوفيد-19)".
من جانبه، أكد النقيب عبد اللطيف بوعشرين عن دفاع (د.ب)، أن "هيئة الحكم قررت، في جلسة اليوم، إعفاء موكلته من الحضور في الجلسات المقبلة اعتبار لوضعيتها الصحية (وضعية حامل)، فيما سيتم مساءلة باقي المتهمات والمشتكين في جلسة لاحقة بتاريخ 21 أكتوبر الجاري".
وأوضح السيد بوعشرين، في تصريح للصحافة، أن أسئلة محكمة الاستئناف كانت "وجيهة وعميقة" في مدلولها وإجابة (د.ب) كانت "حاسمة"، ليتقرر بعد ذلك تأجيل هذا الملف من أجل الاستماع إلى باقي المتهمات في محاكمة حضورية.
بدوره، أكد المحامي بهيئة بمراكش، السيد موسى الشرع، في تصريح مماثل، أن "المحكمة قررت في جلستها الثانية تأخير الملف بناء على طلب طرف الدفاع المدني الذي التمس مهلة لإعداد مطالبه المدنية، وإحضار باقي المتهمات الثلاث إلى جلسة حضورية لمساءلتهن وإثارة الدفوع الشكلية".
وكانت المحكمة الابتدائية بمراكش، قد قضت نهاية يوليوز الماضي، بإدانة (د.ب) المتابعة في ملف الحساب الإلكتروني "حمزة مون بيبي"، بثمانية أشهر سجنا نافذا، فيما قضت في حق شقيقتها (ا.ب) وفي حق (ع.ش)، المتابعتين في حالة اعتقال، على التوالي، بسنة واحدة سجنا نافذا وسنة ونصف سجنا نافذا".
كما قضت هيئة الحكم، بالسجن 10 أشهر حبسا نافذا في حق (ص.ش) المتابعة بدورها في حالة اعتقال، مع تغريم جميع المتهمات مبلغ 10 آلآف درهم.
وتضمن صك الاتهام، كل حسب المنسوب إليها، "المشاركة في الدخول إلى نظام المعالجة الآلية للمعطيات عن طريق الاحتيال، والمشاركة عمدا في عرقلة سير هذا النظام وإحداث اضطراب فيه وتغيير طريقة معالجته".
كما تضمن "بث وتوزيع أقوال أشخاص وصورهم دون موافقتهم عن طريق الأنظمة المعلوماتية، وبث وقائع كاذبة قصد المساس بالحياة الخاصة للأشخاص قصد التشهير بهم والمشاركة في ذلك والتهديد".
