القرقوبي يجر رئيس الحكومة ووزير الصحة أمام ابتدائية تمارة

عقدت الهيئة القضائية بالمحكمة الابتدائية بتمارة جلسة ثالثة مساء يوم 25 ابريل 2019 للنظر في ملف يتعلق بالاتجار في الأقراص المهيجة، المتابع فيه ثلاثة شبان، إثر حجز 22288 قرص مهلوس.
وأفاد الأستاذ مصطفى بوظهر، المحامي بهيئة الرباط، أنه تقدم بلتمس يرمي إلى استدعاء كل من رئيس الحكومة، ووزير الصحة، ورئيس لجنة تقصي الحقائق النيابية في قضايا المخدرات، والمشكلة إبان سنة 1971، و1979، و1995.
وكان الأستاذ بوظهر قد تقدم بمقال، أمام ذات الهيئة القضائية، يرمي إلى إدخال الغير في الدعوى، حيث طالب بإدخال الأطراف الثلاثة المشار إليهم آنفا، وذلك بتحمل مسؤولية تفشي ظاهرة المخدرات بشتى أنواعها، لعدم اتخاذ الإجراءات المتطلبة من مراقبة ووقاية، وعرض تقارير في الموضوع، وغيرها من الإجراءات، وبالتالي القول بمسؤولية كل واحد منهم في حدود اختصاصه، في ظل انتشار آفة المخدرات والعقاقير المؤثرة على الذهن.
وقدم مقال إدخال الغير لفائدة الجمعية المغربية لمحاربة التدخين والمخدرات، بغية استدعاء كل من رئيس الحكومة ووزير الصحة والممثل القانوني لرئيس لجن تقصي الحقائق في المخدرات، بهدف تحديد مسؤولية كل طرف في تفشي آفة المخدرات بشكل مهول، ومحاسبته في حدود اختصاصه، وترتيب الجزاء عن المسؤولية التقصيرية، خصوصا أن المغرب صادق على العديد من الاتفاقيات الدولية المتعلقة بزجر الإدمان على المخدرات السامة، والعقاقير المنشطة للدهن، وكذا مكافحة الاتجار غير المشروع في المخدرات والمؤثرات العقلية، المؤرخة على التوالي في 22 أكتوبر 1966، و17 دجنبر 1980، و29 يناير 2002.
وطالبت الجمعية المغربية لمحاربة التدخين والمخدرات الحكم لها كمطالبة بالحق المدني بدرهم رمزي على كل واحد من المدخلين في الدعوى، نظرا لما أصاب المجتمع المدني من أضرار بسبب تفشي المخدرات.
وأفاد مصدر أن ملفا آخر يعرض على نفس المحكمة تقدر فيه كمية الأقراص المهلوسة بـ 30 ألف قرص.
