القضاء الإداري يرد الإعتبار لموظف بإستئنافية مراكش بعد إعفائه من وزير العدل
أصدرت المحكمة الإدارية بمدينة مراكش مؤخرا حكما ألغت من خلاله القرار الصادر عن وزير العدل، والقاضي بإعفاء رئيس كتابة الضبط لدى محكمة الاستئناف بمدينة مراكش، وذلك لاتسامه بالشطط والانحراف في استعمال السلطة.
وحسب منطوق حكم إدارية مراكش، فإن طلب إلغاء القرار الصادر عن وزير العدل تحت عدد 18/29849 م. م. ب بتاريخ 17 نونبر 2018، يتسم بالانحراف والشطط في استعمال السلطة، كما أنه لا يتوفر على أي تعليل، مع مخالفته للقانون بالإضافة الى وجود عيب في السبب الذي بني عليه.
هذا، ويتعلق الأمر بموظف كان يشتغل بمحكمة استئناف مدينة مراكش في إطار منتدب قضائي من الدرجة الأولى، وتم تعيينه في إطار المسؤولية كرئيس لمصلحة كتابة الضبط بالمحكمة الابتدائية لسيدي بنور بمقتضى القرار الوزاري عدد 10/15456، وذلك قبل ان يتم تعيينه سنة 2012 كرئيس لمصلحة كتابة الضبط باستئنافية مراكش، بمقتضى القرار الوزاري عدد 12/2781.
