قضت الغرفة الجنحية التلبسية التأديبية لدى المحكمة الإبتدائية بمراكش، أمس الجمعة 29 ماي الجاري، بإدانة شخصين بشهر حبسا موقوف التنفيذ و غرامة مالية قدرها 1000 درهم، وذلك من أجل الإفطار العلني وتعاطي المخدرات في شهر رمضان.
وكانت عناصر الأمن قد أوقفت الثلاثاء 27 أبريل الماضي، شخصين من أجل الإفطار العلني في شهر رمضان، بحي رياض الزيتون الجديد بملحة الباهية بمقاطعة مراكش المدينة، وذلك على خلفية اتصال لمواطنين كانت قد توصلت به المصالح الولائية للأمن يفيد إجهار أشخاص بالإفطار، حيث تم اقتياد الموقوفين إلى الدائرة الأمنية الرابعة بعرصة المعاش، من أجل تحرير محضر بإيقافها قبل إحالتهما على المصلحة الولائية للشرطة القضائية.
ويجرم القانون الإجهار بالإفطار في رمضان، طبقا للفصل 222 من القانون الجنائي الذي ينص على أن « كل من عرف باعتناقه الدين الإسلامي وتجاهر بالإفطار في نهار رمضان، في مكان عمومي، دون عذر شرعي، يعاقب بالحبس من شهر إلى 6 أشهر وغرامة لا تقل عن 200 درهم ».
