الجمعية المغربية لحماية المال العام: الحكومة تمهد لحماية الفساد وتكميم أفواه المجتمع المدني
في بلاغ صادر يوم امس الثلاثاء 3 شتنبر 2024، أعلنت الجمعية المغربية لحماية المال العام عن استنكارها الشديد للإجراءات الحكومية الجديدة التي اعتبرتها تضييقاً على الحق في اللجوء إلى القضاء للإبلاغ عن جرائم الفساد ونهب المال العام. وجاء هذا البلاغ عقب اجتماع استثنائي عقده المكتب الوطني للجمعية عن بعد، خُصص لمناقشة تصريحات وزير العدل، التي تُترجم في مشروع قانون المسطرة الجنائية، والذي تم اعتماده من قبل الحكومة.
ووفقًا لما ورد في البلاغ، فإن الجمعية المغربية لحماية المال العام ترى في المادة الثالثة من مشروع القانون، التي تنص على أن الأبحاث القضائية في الجرائم المتعلقة بالمال العام لا يمكن أن تُقام إلا من طرف رئيس النيابة العامة بناءً على تقارير واردة من جهات محددة، تقييداً واضحاً لحق منظمات المجتمع المدني في ممارسة دورها في مكافحة الفساد. كما انتقدت الجمعية المادة السابعة من نفس المشروع، التي تفرض على الجمعيات الحصول على إذن من وزير العدل للتقاضي كطرف مدني، وفق شروط تحددها نصوص تنظيمية.
وأعربت الجمعية، في بلاغها، عن قلقها من « وجود إرادة حكومية لتكريس تراجع حقوقي وقانوني ودستوري »، معتبرة أن هذا التوجه يتجاهل التزامات المغرب الدولية والوطنية، ويهدد التراكمات الإيجابية المحققة في الممارسة الجمعوية والحقوقية.
وفي ضوء ذلك، أعلن المكتب الوطني للجمعية عن مجموعة من المواقف، من بينها:
– إدانة محاولة الحكومة تقييد حق الجمعيات المدنية في اللجوء إلى القضاء للإبلاغ عن جرائم الفساد المالي.
– شجب محاولات تمرير قوانين « تراجعية وغير دستورية »، معتبرة ذلك انتهاكاً لحقوق الإنسان وحماية للمفسدين.
– رفض حصر حق تحريك الأبحاث القضائية في يد رئيس النيابة العامة، واعتبار ذلك تدخلاً سافراً في السلطة القضائية.
– التنديد بتوجه وزير العدل لرفع الشكايات ضد الصحافيين، خاصة الصحفي حميد المهداوي الذي تقررت متابعته بموجب القانون الجنائي بدلاً من قانون الصحافة.
كما أشار البلاغ إلى أن الجمعية تعتزم فتح مشاورات مع هيئات ديمقراطية وحقوقية لتأسيس إطار يجمع الطاقات المختلفة لمناهضة الفساد، ودعت إلى تنظيم وقفة احتجاجية يوم السبت 21 شتنبر 2024 أمام البرلمان تحت شعار « لا للتضييق على المجتمع المدني، لا للفساد ونهب المال العام ». وحث البلاغ كافة الهيئات السياسية والحقوقية والنقابية والمواطنين على المشاركة بكثافة في هذه الوقفة، رفضاً لـ »سياسة تكميم الأفواه والتضييق على الجمعيات الحقوقية ».
