المنصوري تصدر مذكرة تبسيط مسطرة الترخيص بالبناء في المجال القروي
قامت وزارة إعداد التراب الوطني والتعمير والإسكان وسياسة المدينة، ووزارة الداخلية، بإصدار دورية مشتركة، أمس لجمعة ( 28 أبريل)، تهدف الى تبسيط مسطرة الترخيص بالبناء في الوسط القروي .
وأبرزت وزارة إعداد التراب الوطني والتعمير والإسكان وسياسة المدينة، في بلاغ، أن هذه الدورية المشتركة، الموجهة إلى الولاة والعمال ورؤساء مجالس الجماعات، ومديري الوكالات الحضرية والمفتشين الجهويين لإعداد التراب الوطني والتعمير والهندسة المعمارية، والتي تدعوهم لاتخاذ مجموعة من الإجراءات المضمنة فيها وتفعيلها، تأتي تنفيذا للتعليمات الملكية السامية التي تهدف إلى تنمية العالم القروي والحد من الفوارق الاجتماعية والتفاوتات المجالية ولا سيما فيما يخص التعمير والبناء.
وأضاف المصدر ذاته أن هذه الدورية المشتركة تندرج في سياق المجهودات المتواصلة لوزارة إعداد التراب الوطني والتعمير والإسكان وسياسة المدينة وباقي الفرقاء المعنيين من أجل تأطير عملية البناء بالوسط القروي، كتعميم تغطية المجالات القروية بوثائق التعمير لتفادي الإكراهات المرتبطة بغياب الوثائق المرجعية المنظمة لهذه المجالات، وكذا وضع برنامج المساعدة المعمارية والتقنية المجانية انسجاما مع الخصوصيات المحلية، إلى غير ذلك من التدابير والإجراءات التي تروم تبسيط مساطر الترخيص بالمجال القروي وضمان إطار عيش كريم للمواطنات والمواطنين.
وعلى الرغم من المجهودات المبذولة، يقول البلاغ، يتضح أن الترخيص بالبناء في هذا الوسط، لا زال يعرف بعض الإكراهات والصعوبات، تتعلق أساسا بالمساحة الدنيا الواجب توفرها في مشاريع البناء المزمع إنجازها، وكذا نسبة مساحة الأرض المتعين بناؤها وعلو البناية، بالإضافة إلى إكراهات أخرى ذات طابع تقني وعقاري.
وفي ظل هذا السياق، تصدر هذه الدورية المشتركة التي تدعو إلى الحرص على تفعيل واتخاذ الإجراءات المضمنة فيها لإضفاء المزيد من التبسيط على مسطرة الترخيص بالبناء في الوسط القروي، وذلك على النحو التالي : تحديد مدارات الدواوير غير المغطاة بوثائق التعمير من طرف لجنة إقليمية يحدثها الولاة والعمال، تحت إشرافهم، من أجل توحيد طرق التعامل مع ملفات الترخيص بالبناء في الوسط القروي، وتمكين الساكنة داخل هذه المدارات من الحصول على تراخيص بناء دون اشتراط مساحة الهكتار الواحد، مادام أن الأمر يتعلق ببنايات غير متفرقة مع الحفاظ على المؤهلات والموارد الطبيعية وضمان استدامتها، وذلك وفق مسطرة مرفقة بالدورية.
كما تدعو إلى تفعيل انعقاد لجنة الاستثناءات المنصوص عليها في المادة 35 من المرسوم رقم 2.92.832 بتطبيق القانون رقم 12.90 المتعلق بالتعمير، والدعوة لاجتماعها بصفة آلية من طرف رئيس الجماعة أو العامل حسب الحالة، من أجل النظر في طلبات مشاريع البناء التي لا تتوفر فيها الشروط المتعلقة بالمساحة الدنيا للبقعة وبالمساحة المسموح ببنائها وبعلو المبنى شريطة التأكد من أن البناء المزمع إقامته لا تترتب عنه عمليات عمرانية متفرقة ؛ وعدم إلزام المواطنين بوثائق إدارية غير ضرورية، والاكتفاء بالحد الأدنى منها في تكوين ملفات طلبات الرخص المتعلقة بالبناء الفردي، تماشيا مع مقتضيات القانون رقم 55.19 المتعلق بتبسيط المساطر والإجراءات الإدارية، ومراعاة للوضعية الاقتصادية والاجتماعية لهذه الساكنة.
بالإضافة إلى ذلك تحث الدورية على تفعيل أكبر للمساعدة المعمارية والتقنية لفائدة ساكنة الوسط القروي لاسيما بالدواوير التي تم تحديد مداراتها.
وتجدر الإشارة أيضا إلى أن الغاية من إقرار رخصة البناء في المجال القروي تكمن في التحقق من مدى احترام عمليات البناء لمضامين وثائق لتعمير التي تغطي هذه المجالات ولمقتضيات النصوص التشريعية والتنظيمية الجاري به العمل من جهة، وكذا الحرص على سلامة ساكنة هذه المناطق من خلال توفير كافة الضمانات التقنية الكفيلة بتحقيق هذه الغاية من جهة أخرى، يخلص البلاغ.
