الفرقة الوطنية للدرك الملكي تستمع إلى الغلوسي
تم اليوم الأربعاء 13 مارس 2019، الاستماع الى محمد الغلوسي رئيس الجمعية المغربية لحماية المال العام، من طرف الفرقة الوطنية للدرك الملكي بالرباط، وذلك على خلفية شكاية تقدمت بها الجمعية الى الوكيل للعام للملك بالرباط.
واستغرقت جلسة الاستماع الى الغلوسي حوالي 3 ساعات، تم التطرق فيها الى جميع ما جاء في الشكاية المذكورة، والتي تتعلق بالاختلالات المالية والقانونية التي اعترت التدبير العمومي ببلدية الهرهورة.
وتتجلى تلك الاختلالات حسب الشكاية المذكورة، في تسجيل مخالفات على مستوى التعمير ببلدية الهرهورة، حيث تم منح ما لا يقل عن 13 رخصة لإقامة مشاريع كبرى دون الحصول على موافقة الوكالة الحضرية، رغم إلزامية هذه الموافقة، طبقا للقوانين ذات الصلة أي ، المادة 101 من القانون التنظيمي رقم 113.14 المتعلق بالجماعات المحلية ، و المادة 35 من المرسوم رقم 2.13.424 بتاريخ 24 / 05 / 2013 المتعلق بالموافقة على ضابط البناء العام، منح رخص بإقامة مشاريع كبرى على الساحل دون إنجاز المشاريع المتعلقة بالتأثير على البيئة و هو ما يعتبر خرقا سافرا لما تنص عليه المادة 2 من القانون رقم 12.03 المتعلق بدراسة التأثير على البيئة. ومن ضمن تلك المشاريع، مشروع الهدى، مشروع سهب الأمل ومشروع سهب الذهب للاصطياف.. وهي مخالفات ذكرت الجمعية على ان لها تأثير سلبي على البيئة السليمة خاصة في منطقة ذات نمو سكاني مطرد؛ الترخيص لمشاريع في مجال التعمير دون تمكين السلطة المحلية بنسخ من تلك الرخص المسلمة، كما تنص على ذلك المادة 116 من القانون التنظيمي رقم 113.14 المتعلق بالجماعات وكذا المادة 3 من القانون رقم25.90 ، المتعلق بالتجزئات العقارية والمجموعات السكنية وتقسيم العقارات كما تم تتميمه بموجب المادة 50 من القانون رقم 66.12 المتعلق بزجر المخالفات في مجال التعمير والبناء، مما فوت على السلطة المحلية فرصة مراقبة ضوابط البناء وترتيب الآثار القانونية في حق المخالفي، وهو ما فوت على الجماعة أيضا مداخيل جد مهمة؛ عدم احترام الغرض الأساسي الذي بموجبه حصل مشروع سهب الذهب للاصطياف الخاص بجمعية موظفي وزارة التجهيز على الموافقة المبدئية للجنة الاستثناء والذي يهم مجموعة من الموظفين على أساس طابع الاستفادة العامة، إلا أن ما تم إنجازه يعد تجزئة سكنية مكونة من فيلات متفرقة تم تحديد المستفيدين قبل تسليم المشروع…؛ الترخيص بإنجاز مشروع ودادية سطات ـ الشطر الثالث ومشروع سهب الأمان دون احترام تصميم التهيئة وكذا الضوابط القانونية ذات الصلة بالتعمير خاصة المادة 27 من القانون رقم 12.90 المتعلق بالتعمير؛ منح شواهد التسليم المؤقت بشكل انفرادي دون موافقة اللجنة المكلفة بالتسليم المؤقت لمشروع الفردوس وذلك مخالفة لمقتضيات المادتين 24 و 25 رقم 25.90 المتعلق بالتجزئات العقارية والمجموعات السكنية وتقسيم العقارات؛ منح شهادة التسليم المؤقت لمجموعتين سكنيتين وهما ودادية الفردوس وأمل35 دون المرافق الأخرى التي تضم الطرق وكذا المساحات المخصصة للمنشآت ذات المصلحة العامة لكونها غير مجهزة أو غير مطابقة للتصميم المرخص له، وهو الشيء الذي يفوت على الجماعة أموالا مهمة بهذه القرارات؛ الإقدام على تسليم شهادة القسمة والإدماج لشركة لوريفاج سان جيرمان من أجل استخراج قطع أرضية وإدماجها في رسم عقاري آخر دون الحصول على الرأي الملزم للوكالة الحضرية كما هو منصوص عليه في المادة 20 من المرسوم التطبيقي للقانون رقم 25.90 المتعلق بالتجزئات العقارية والمجموعات السكنية وتقسيم العقارات؛ عدم اللجوء من أجل التسليم المؤقت لأشغال تجهيز تجزئات …
