طالب القيادي في الأصالة والمعاصرة عبداللطيف وهبي، من محمد أوجار وزير العدل إعلان أسباب تقاعس وزارة العدل في إحالة ملف النائب البرلماني في حزب الأحرار محمد بوهدود بودلال على المحكمة الدستورية لاتخاذ إجراءات في حقه، بعدما أدانته المحكمة في جرائم انتخابية بأحكام نهائية.
وقال وهبي في سؤال كتابي وجهه صباح اليوم لوزير العدل أنه "وفقا لمقتضيات القانون التنظيمي رقم 27.11 المتعلق بمجلس النواب، فإنه بلغ إلى علمنا صدور حكم قضائي نهائي في مواجهة السيد النائب محمد بوهدود بودلال المنتمي لحزب التجمع الوطني للأحرار، ملف عدد 21958 /6/3/2016 قرار بتاريخ 27/9/2017 تحت عدد 1445 وقد أثار استغرابنا عدم قيام النيابة العامة لدى محكمة النقض إلى حدود يومه بإحالة الملف على المحكمة الدستورية، لترتيب الآثار القانونية على هذا الحكم القضائي البات"
وأكد وهبي في نفس السؤال أنه "إذا كان القانون يمنعنا من مسائلة السلطة القضائية والتي من ضمنها جهاز النيابة العامة في شخص السيد الوكيل العام للملك بمحكمة النقض، فإن حماية حسن تطبيق الدستور والقوانين التنظيمية، يدخل في صميم العمل الحكومي، إضافة إلى ذلك فإن مقتضيات المادة 11 من القانون التنظيمي رقم 27.11 المتعلق بمجلس النواب، تمنح لكم وبشكل صريح، الحق في إحالة هذا الملف على المحكمة الدستورية علما أن الحكم صدر منذ أكثر من 13 شهرا وهذا لا يليق بالاحترام الواجب لمؤسسة دستورية في مكانة مجلس النواب" يقول وهبي.
الجدير بالذكر أن وهبي وجه رسالة مماثلة في الموضوع إلى الحبيب المالكي رئيس مجلس النواب وباقي أعضاء مكتب مجلس النواب، يتساءل من خلالها عن عدم إحالة مكتب مجلس النواب بدوره الملف على المحكمة الدستورية رغم وجود حكم قضائي نهائي.
وقال وهبي في رسالته الموجهة إلى المالكي ومكتبه "إننا نطالب مكتبكم بتوضيحات حول وضعية هذا النائب الذي تمت متابعته سابقا، وصدر في حقه حكما نهائيا، مند أزيد من 13 شهرا، وهذا يوضح بجلاء تقاعس مكتبكم في القيام بمهامه في تتبع وضعية السادة النواب الذين تتضارب وضعيتهم مع الدستور والقوانين التنظيمية الجاري بها العمل".
