جرائم تكيف من جنحة الى جناية في ظل الظروف الصعبة التي يشهدها المغرب
تحدثث مجموعة من وسائل الإعلام مؤخراً عن إمكانية ان تعتمد الدولة المغربية في مواجهة الجريمة على اختلاف أشكالها و إعادة تكيف الجنحة الى جناية في ظل ما تشهده البلاد جراء تفشي فيروس كورونا.
وقد سبق وأصدرت المحكمة الابتدائية بمدينة القنيطرة المغربية حكما مثيرا و استثنائي حيث اعتبرت فيه أن جنحة السرقة خلال فترة حالة الطوارئ الصحية المطبقة في البلاد حاليا تُعد جناية وليست جنحة، بدعوى أن جائحة كورونا تعد كارثة ، وذلك استنادا إلى مقتضيات الفصل 510 من القانون الجنائي المغربي.
و تأتي هذه المقاربة القانونية القضائية في إطار تفعيل سياسة التجريم والعقاب في ظل حالة الطوارئ الصحي لردع الجناة و التصدي لظاهرة الجريمة .
وفي سياق آخر إلتمس المركز المغربي للحماية من الإبتزاز الإلكتروني من الجهات القضائية المختصة منها رئاسة النيابة العامة بالمغرب ان يتم تكييف جريمة الإبتزاز الإلكتروني من جنحة إلى جناية للحفاظ على الأمن المجتمعي في جميع أبعاده الأخلاقي و الرقمي والحقوقي والإجتماعي خصوصا في مثل هذه الظروف الراهنة المتعلقة بمكافحة فيروس كورونا و تداعياته.
