مقترح قانون يتوعد من يمارس مهنة طب الأسنان بشكل غير قانوني بالحبس والغرامة
تقدمت المجموعة النيابية لحزب العدالة والتنمية بمجلس النواب بمقترح قانون يبتغي تنظيم مزاولة مهنة طب الأسنان، ويقترح النص القانوني معاقبة كل من يمارس مهنة طب الأسنان بوجه غير قانوني بعقوبة حبسية تتراوح بين ثلاثة أشهرو خمس سنوات، وبغرامة من 10.000 درهم إلى 100.000 درهم، وشدد على اقتصار ممارسة المهنة على من يتوفر على شهادة الدكتوراه في طب الأسنان من أحد كليات طب الأسنان المغربية أو ما يعادلها من دبلوم معترف به مسلم من مؤسسة أجنبية يخول لحامله مزاولة المهنة، أو حائز على دبلوم من الخارج في المجال معترف بمعادلتها للدبلوم الوطني، كما اشترط مقترح القانون ألا يكون قد صدر في حق من يريد ممارسة مهنة طب الأسنان مقرر بالإدانة مكتسب لقوة الشيء المقضي به من أجل ارتكاب جناية أو جنحة ضد الأشخاص أو نظام الأسرة أو الأخلاق العامة.
ويقضي النص المقترح بإنزال العقوبة بكل شخص غير مرخص بمزاولة مهنة طب الأسنان يقوم بالمشاركة غير الاعتيادية في إعداد تشخيص أو وصف علاج لأمراض الفم والأسنان ولو بحضور الطبيب، أو القيام بأخذ قياسات الفم والأسنان وذلك عن طريق أعمال تشخيصية أو استشارات شفوية أو مكتوبة وبأي طريقة أخرى.
ويدين نص المقترح كل شخص غير مرخص له مزاولة المهنة ضبطت في حوزته آلات أو أدوات طبية، مالم يثبت أن وجودها لديه له سبب مشروع غير مزاولة مهن طب وجراحة الأسنان، كما يعاقب كل من يستعمل نشرات أو لوحات أو لافتات أو أي وسيلة أخرى، إلى جانب كل من ينتحل لقب طبيب أسنان.
