مجلس المستشارين يصادق على منح الأطفال ضحايا زلزال الحوز صفة مكفولي الأمة
صادق مجلس المستشارين في جلسة عامة تشريعية عقدها مساء أمس الثلاثاء، بالإجماع، على مشروع قانون رقم 50.23 في شأن منح الأطفال ضحايا زلزال الحوز صفة مكفولي الأمة.
وأوضح الوزير المنتدب لدى رئيس الحكومة المكلف بإدارة الدفاع الوطني، عبد اللطيف لوديي، خلال تقديمه لمضامين مشروع القانون، أنه يندرج في إطار التعليمات السامية للملك محمد السادس، من أجل التكفل الفوري بالأطفال اليتامى الذين فقدوا أسرهم وأصبحوا بدون مورد، إثر الزلزال العنيف الذي ضرب إقليم الحوز بتاريخ 8 شتنبر الماضي والذي امتدت آثاره إلى كل من عمالة مراكش وأقاليم شيشاوة وتارودانت وورزازات وأزيلال.
وأكد لوديي أنه تم إعداد مشروع القانون هذا، الذي جاء متضمنا لثلاث مواد، من أجل تمديد الأحكام المتعلقة بالحقوق المنصوص عليها في القانون رقم 33.97 المتعلق بمكفولي الأمة الصادر بتنفيذه الظهير الشريف بتاريخ 25 غشت 1999، باعتباره النص المؤطر، ليشمل الأطفال ضحايا زلزال الحوز المتوفرة فيهم شروط التمتع بصفة مكفولي الأمة، على غرار ما تم العمل به بالنسبة للأطفال ضحايا الزلزال الذي ضرب إقليم الحسيمة سنة 2004.
وأبرز أن مشروع القانون يهدف إلى إقرار مقتضيات في شأن منح الأطفال ضحايا زلزال الحوز صفة مكفولي الأمة، مشيرا إلى أنه حدد شروط منح صفة مكفولي الأمة لضحايا زلزال الحوز، من خلال التنصيص على منح هذه الصفة لهؤلاء الأطفال الذين يكون أبوهم أو سندهم الرئيسي قد توفي على إثر جروح من جراء هذا الزلزال، أو أصبح عاجزا بدنيا أو فُقد، إذا تبين من ظروف اختفائه أنه توفي على إثر هذا الزلزال.
وتابع لوديي أنه على غرار القوانين المعمول بها في هذا الإطار، فقد اعتبر مشروع هذا القانون السند الرئيسي، كل شخص كان يتكفل بالطفل عند وفاة الأب أو حتى قيد حياته، مضيفا أنه للسهر على تطبيق أحكام مشروع القانون، تنص المادة الثانية منه على إحداث لجنة إدارية على مستوى كل من عمالة مراكش وأقاليم كل من الحوز وشيشاوة وتارودانت وورزازات وأزيلال، يناط بها حصر وإعداد قائمة الأطفال المستفيدين من صفة مكفولي الأمة، ويحدد تأليفها وكيفية اشتغالها بقرار لرئيس الحكومة.
وأفاد بأن مؤسسة الحسن الثاني للأعمال الاجتماعية لقدماء العسكريين وقدماء المحاربين ستعمل على اتخاذ مجموعة من الإجراءات والترتيبات، بعد إقرار مشروع هذا القانون وصدوره للسهر على التطبيق السريع والأمثل لمقتضياته.
وبخصوص الحقوق المخولة للأطفال ضحايا زلزال الحوز المتمتعين بصفة مكفولي الأمة، أورد الوزير المنتدب أن مشروع القانون، الذي ستسري أحكامه ابتداء من 8 شتنبر 2023، نصّ، على تخويل هؤلاء الأطفال كافة الحقوق المنصوص عليها في القانون 33.97 المقررة لفائدة مكفولي الأمة، من خلال استفادتهم من الدعم المادي والمعنوي الممنوح من طرف الدولة والمتمثل أساسا في إعانة إجمالية بمبلغ شهري حُدد في 1250 درهم.
كما يستفيد هؤلاء الأطفال، يضيف لوديي، كذلك من مجانية العلاجات الطبية والجراحية والاستشفاء والتشكيلات الصحية المدنية والعسكرية التابعة للدولة، وتخفيضات متعددة للتنقل عبر كافة وسائل النقل السككي، بالإضافة إلى دعم مالي عند كل دخول مدرسي وإعانة مالية بمناسبة عيد الأضحى لكل عائلة.
وذكر في هذا السياق أنه ستكون لهؤلاء الأطفال ضحايا زلزال الحوز، الأسبقية في الالتحاق في مؤسسات التعليم و التكوين وفي الحصول على المنح الدراسية والأسبقية لولوج المناصب العمومية في إدارات الدولة والمؤسسات العمومية والجماعات الترابية.
