محكمة ابتدائية تقضي بإبطال محضر معاينة أنجزه مفوض قضائي بسبب عدم احترامه مقتضيات المادة 15 من القانون 81.03

أصدرت المحكمة الابتدائية بمدينة تنغير بتاريخ 22/02/2021 حكما قضائيا يقضي بإبطال محضر معاينة مجردة منجز من طرف مفوض قضائي بناء على طلب المدعى عليها في الدعوى .
و تعود تفاصيل القضية إلى أن المدعى عليها ( ل. م ) انتدبت المفوض القضائي ( ه. ه ) قصد المعاينة المجردة لعيادة العارض ومعاينة عملية الطرد من العمل و تحرير محضر بذلك بهدف الرجوع إليه عند الإقتضاء.
و قضت المحكمة الإبتدائية المشار إليها أعلاه بإبطال هذا المحضر، مبررة ذلك بعدم احترامه لمقتضيات المادة 15 من القانون رقم 81.03 المتعلق بتنظيم مهنة مفوض قضائي خاصة الفقرة الخامسة منها.
وعللت المحكمة حكمها القاضي بإبطال محضر المعاينة المجردة، بكونه يتضمن عبارات لا تتسم بالحياد والتجرد من الرأي، واصفة إياها بتخمينات و تأويلات و تفسيرات لا سند لها.
و تنص المادة 15 في الفقرتين الرابعة والخامسة من القانون رقم 81.03 المتعلق بمهنة المفوضين القضائيين على مايلي :
ينتدب المفوض القضائي من لدن القضاء للقيام بمعاينات مادية محضة مجردة من كل رأي، ويمكن له أيضا القيام بمعاينات من نفس النوع مباشرة بطلب ممن يعنيه الأمر.
يمكن للمفوض القضائي أن ينيب عنه تحت مسؤوليته كاتبا محلفا أو أكثر للقيام بعمليات التبليغ فقط وفق أحكام الباب العاشر من هذا القانون
