محاربة العبث بالمال العام..لا هدنة و لا تقادم
جرائم المال العام .. لايجب ان تكو ن محل تساهل اوتقادم…!
تنكب لجنة العدل والتشريع بمجلس النواب هذه الايام، على مناقشة التعديلات التي تقترح الحكومة ادخالها على القانون الجنائي، والمتعلقة بالاثراء غير المشروع بالنسبة للذين تحملوا مسؤوليات عمومية، لفترة زمنية معينة وكذلك بالنسبة لغيرهم من الموظفين العموميين عموما وابنائهم، حيث حرصت الحكومة على أن تقتصر التعديلات على الغرامات المالية وحدها، والتي تبتدئ من مائة الف درهم لتصل الى مليون درهم، مع استبعاد العقوبات السجنية.
تعلل الحكومة حرصها على عدم إدراج العقوبات السجنية في مقترح التعديل هذا، بامكانية استغلالها من قبل اي حكومة ضد جهة سياسية معينة، في الوقت الذي يتشبث فيه فريق الوحدة والتعادلية، بابقاء العقوبة السالبة للحرية إلى جانب الغرامة المالية.
واذا كانت هناك نية صادقة فعلا في محاربة ظاهرة الإثراء غير المشروع، فانه يجب إجراء مسطرة ألتشدد بالنسبة لكل من ثبت في حقه، انه عبث بالمال العام وظهر عليه ثراء طارئ نتيجة هذا العبث ، على الا يقتصر الأمر على الغرامة المالية وحدها، بل ان يتعداه إلى فرض العقوبة السجنية ايضا، مع تفعيل مسطرة التتريك التي كانت متبعة من قبل المخزن قديما، لممتلكات الأصول والفروع معا، على أن يسري هذا الإجراء على المسؤولين السابقين واللاحقين، اعتبارا لكون جرائم المال العام لاتقادم فيها.
ومن ثم فإن امثال الزعيم السابق للحزب العتيد والمستثمر الحالي في كل من ألمانيا وتركيا، يجب أن يكون من الذين تطبق في حقهم هذه العقوبات، بعد مساءلته بطبيعة الحال عن مصدر ثروته وثروة ابنائه، وكذلك عددا من رؤساء الجهات والبلديات الذين طرأ عليهم الثراء، بعد أن كانوا الى الامس القريب لا يملكون شيئا، امثال رئيس إحدى البلديات الذي أقام مؤخرا عرس القرن لنجله البار، كلفه ملايير السنتيمات واصبح حديث الخاص والعام، في مدينة تفتقر لأبسط البنيات التحتية، وقد قضى أزيد من عقدين كرئيس لبلديتها.
أن تفعيل الدستور الذي تنص إحدى بنوده على ربط المسؤولية بالمحاسبة، هو وحده الكفيل مستقبلا بقطع الطريق على العابثين بالمال العام وأعادة الأمور إلى نصابها.
