« ماكاينش شيك ضمان ، ما كاين علاج « …الفنانة ماهماه تفضح التجاوزات القانونية للمصحات الخاصة

 

نشرت الممثلة المقتدرة « عائشة ماهماه » تدوينة على صفحتها الرسمية بالفايسبوك، كشفت من خلالها عن تدهور حالتها الصحية، مع وضع صورة مرافقة لها، تؤكد ذلك.

 

وكشفت الفنانة ماهماه أنها تواجه مشاكل صحية، حيث تتواجد في المستشفى، الذي لجأت إليه بعدما لم تستطع اكمال العلاج داخل المصحة الخاصة التي كانت ترقد فيها، بدعوى عدم توفرها على شيك ضمان.

 

وجاء في تدوينة الفنانة عائشة ماهماه “ماكاينش شيك ضمان ماكاينش علاج ، جراو عليا من لاكلينيك حتى يكون عندي شيك للعلاج ، يارب ارحمنا…. الله الوطن الملك ».

 

وأعادت هذه الواقعة طرح إشكالية التجاوزات القانونية التي تعرفها المصحات الخاصة بالمغرب، من بينها فرض التوفر على شيك كضمانة مقابل الولوج، قبل تسديد الواجبات، وهو ما لم تستطع الجهات المسؤولة وضع حد له.

 

وبالعودة إلى فصول مدونة التجارة، والقانون الجنائي، فإن مقتضياتهما تمنع منعا قاطعا التعامل بشيك الضمان، بل إن من يتعامل بهذه المعامل يعرض نفسه لعقوبة حبسية يمكن أن تصل إلى خمس سنوات سجنا، وغرامة قد تصل إلى عشرة آلاف درهم، حيث تنص المادة 316 من مدونة التجارة على أنه “يعاقب بالحبس من سنة إلى خمس سنوات، وبغرامة مالية تتراوح ما بين 2000 و10.000 درهم… كل شخص قام عن علم بقبول أو تظهير شيك شرط ألا يستخلص فورا وأن يحتفظ به على سبيل الضمان”.

 

وينص الفصل 544 من القانون الجنائي المغربي على أن “من قبل شيكا بشرط ألا يُصرف فورا وأن يحتفظ به كضمانة يعقاب بالعقوبات المقررة في الفقرة الأولى من الفصل 540، على ألا تقلّ الغرامة عن قيمة الشيك”. وتتراوح العقوبات الواردة في الفصل 540 بين سنة وخمس سنوات حبسا، وغرامة من 500 إلى 5000 درهم
