قرار محكمة النقض… ممارسة أنثى قاصر لعلاقة جنسية غير شرعية لا يشكل جنحة الفساد

اعتبرت محكمة النقض في قرار صدر عنها سابقاً أن ممارسة انثى قاصر لعلاقة جنسية غير شرعية لا يشكل جنحة فساد بل جريمة هتك عرض قاصر، مشيرة إلى انه بمقتضى الفصل 490 من القانون الجنائي فإن الركن المادي للجريمة غير قائم.
وعللت محكمة النقض قرارها بكون الفاعلة حدثة لم تبلغ بعد السن المذكور في ذات الفصل أعلاه، معتبرة الانثى القاصر ضحية وليست جانية، في إطار مقتضيات الفصل 484 من القانون الجنائي المغربي المتعلق بهتك عرض قاصر يقل سنه عن 18 سنة بدون عنف .
وينص الفصل 484 من القانون الجنائي » يعاقب بالحبس من سنتين إلى خمس سنوات من هتك دون عنف او حاول هتك عرض قاصر تقل سنه عن ثمان عشرة سنة أو عاجز أو معاق أو شخص معروف بضعف قواه العقلية، سواء كان ذكرا أو أنثى.
ورفضت محكمة النقض تفعيل مقتضيات الفصل 490 من نفس القانون و التي تنص على ان » كل علاقة جنسية بين رجل وإمرأة لا تربط بينهما علاقة الزوجية تكون جريمة الفساد و يعاقب عليها من شهر واخد إلى سنة.
