دعوة إلى مراجعة « مدونة الأسرة » بعد عقدين من اعتمادها بسبب « التمييز ضد المرأة »

دعا المجلس الاقتصادي والاجتماعي بمناسبة اليوم العالمي للمرأة إلى مراجعة مدونة الأسرة، وقال أن الوقت حان للمراجعة لتتلاءم المدونة مع مقتضيات الدستور ومضامين الاتفاقيات الدولية التي وقع عليها المغرب في هذا الإطار، باعتبار أن تحقيق المساواة لا يمكن أن يتحقق دون إطار قانوني منسجم مع طموحات المغرب لتمكين المرأة من حقوقها كاملة دون تمييز المعبر عنها في النموذج التنموي.
وقال المجلس الذي يضطلع بمهام استشارية في جميع القضايا ذات الطابع الاقتصادي والاجتماعي والبيئي أن المدونة حقتت تقدما في مجال حقوق المرأة مقارنة مع وضعها سابقا، وأنها كانت ذات أثر إيجابي في الدفع في اتجاه تطوير العقليات في مجال المساواة بين النساوالرجال، إلا أنها رغم ذلك لا زالت تتضمن أشكالا من التمييز، خص بها الجوانب المتعلقة بالولاية على الأطفال، والزواج المبكر.
ولفتت المؤسسة الدستورية إلى ما تعتبرها أشكالا أخرى من التمييز ضد المرأة، بينها الأموال المكتسبة خلال فترة الزواج، بسبب عدم الاعتراف بالعمل المنزلي الذي تضطلع به المرأة فتحرم من حقها في ذلك المال -المندرج ضمن حق الكد والسعاية- في حال عدم تمكنها من إثبات مساهمتها في تنمية أموال الأسرة بشكل موثق.
ويرى المجلس أن مثل هذه المقتضيات تكرس شعورا لدى النساء بانعدام الأمن الاجتماعي والقانوني والقضائي، ما ينعكس سلبا على حقوقهن ويقلص حرياتهن ويكرس تبعيتهن، ما يحعل مكافحة العنف صعبا في ظل شبح الهشاشة المالية خاصة عقب الطلاق بسبب وجود منظومة وصفها المجلس بـ »غير المنصفة ».
