من المرتقب أن ينظم النساخ القضائيون بمدينة اسفي، يومي 21 و22 دجنبر الجاري، إضرابا انذاريا، وذلك احتجاجا على مجموعة من الممارسات المفروضة عليهم حسب بيان توصل موقعنا بنسخة منه.

وحسب البيان، فإن هذا الإضراب، يأتي انطلاقا من غيرة النساخ القضائيين بأسفي على مهنة النساخة العريقة التي حفظت حقوق المواطنين منذ نشأة التوثيق العدلي، وكذا بعد المضايقات المتكررة التي أصبحت تعاني منها شعبة النساخة بقسم التوثيق بمدينة آسفي، والمتمثلة حسب البيان، في عرقلة إنجاز النسخ العدلية المستخرجة من كنانيش التضمين وذلك بامتناع العدول عن توقيعها رغم استيفائها جميع الشروط القانونية، حيث يضيف ذات المصدر، أن ممارسة ذلك هو من أجل إخضاع تلك النسخ لنظام داخلي خاص بالعدول لم ينص عليه لا القانون 49.00 المنظم لمهنة النساخة ولا القانون 16.03 المنظم لمهنة العدالة، حيث أشار البيان، إلى أن المشرع نص في الفقرة الثانية من المادة التاسعة من المرسوم التنظيمي عدد 2.01.2825 على اقتسام أجرة النسخة بالتساوي بين الناسخ والعدلين الموقعين على النسخة دون تحديد نمط أو نظام معين لهذا التوقيع تيسيرا على المواطنين في الوصول إلى حقوقهم ، وسدا لأي تأويل أو اجتهاد يخدم مصلحة فئة معينة.

ويضيف البيان، أن حتى المسؤولين القضائيين بقسم قضاء الأسرة بآسفي عاجزون عن إلزام العدول بالتقيد بالنصوص القانونية المنظمة للمهنة، مشيرا إلى انه تم استنفاذ جميع السبل الحبية لتجاوز هذه الأزمة المفتعلة، بالإضافة إلى تعطل حقوق المواطنين بسبب هذا المشكل.

وقد ندد النساخ القضائيون بآسفي بما اعتبروه حيفا وإقصاء ممنهجا في حقهم، مستنكرين الضغوطات الممارسة عليهم خارج إطار القانون.

ودعا البيان، المسؤولين القضائيين إلى إنصاف النساخ القضائيين وإخضاع كل الأطراف للقوانين الجاري بها العمل بدل التحيز إلى فئة دون أخرى، مطالبين بتسوية هذا الملف قبل أن تنفلت الأمور إلى ما لا تحمد عقباه مع فتح باب الحوار على أساس الإحتكام لنصوص القانونين المنظمين لمهنتي النساخة والعدالة، حيث أعلن هاته الفئة عن عزمها خوض سلسلة من الخطوات النضالية التصاعدية حتى تحقيق مطالبها التي يكفلها لها القانون.
